the laws out here are stupid would any one here really let some one walk in and hurt a friend i know i wouldnt just like if some one is breaking into your car your better off to beat the out of him and dropp him off in a field or some thing i was told this by a cop after i had a chat with him when some one broke into a friends car.

Hey rob thanks for the description, too bad the rules are so wack but at least some of us have a better understanding of how not to go to jail( however the rules need to be changed you'll get your self killed trying to politely remove people from your property if there breaking in ect )

I would like to say something better but I think it would be fruitless you must look after yourself these days unfortunately.

yes, it is true that you should seek the aid of police in these types of scenarios. what i have learned from experiance is first you get someone to call 911 and then you proceed to take the matter into your own hands. cases like these are not emergency and often times it will take a lil longer for police to show, atleast here it takes a while.
honestly, i do not think you'd get into any trouble for doing what you did. ( I am not a cop)

Only thing he forgot to say was "don't say ANYTHING to the police except that you would like a lawyer present" , that's if you're being detained.
remember, everything you say can be held against you, so lawyer up...
the slightest thing like "i seen them coming so i grabbed a bottler, broke it so i could bottle them" may be construed as premeditated. LAWYER UP!

As sad is this is to say, it also depends on the cop arriving on the scene.
Little story:
About 8 years ago, a friend of mine was dating my little sisters best friend (we are all only 3 years apart). One night after much drinking, my friend got into a fight with his gf and they became physical. When my sister attempted to intervene, he swatted her away and she fell over a table, hitting her head. She called me and told me (while I can hear yelling in the background). I told her to call the police. I went over. By the time I got there, the police were there and had my friend in the police car. I walked up to the car and said "Im the older brother of her *pointing at my sister* Open the door for me. I want to talk to him." The cop said: "Im sorry sir. I cant do that." Fine. After getting all the details in the report, I asked the cop "so, what is he going to get?" Cop said: "admittedly, nothing really. There was no blood or visible wounds of any major type. He admitted to getting physical so at the end of the day, a slap on the wrist. Maybe some probation or whatever." I looked the cop in the eye and said "I want one shot at him." He nodded and said "sorry, I cant do that. But Im going to call another car to bring him to the station." And walked away. I followed behind him. He got to the car and looked around to see if I was there. I was. He opened the car door and pulled him out of the drivers side (there was no other cop car around). I walked him around to the passenger side of the car, pushed him front first against the hood and went to open the passenger door. I walked over, gave my ex-friend a good number of shots and dropped him to the floor. He picked up my friend put him back in the car and then "questioned" me. No report was filed and nothing ever happened.
All of that to say when a cop realizes the situation and he is a human being and not a ****tard, the situation will get resolved pretty quickly.

what a story. its nice to know that there are cops who let your constitutional rights be violated as well as there are individuals such as yourself who like to hit drunk people. Im guessing an apology could not be the simpler solution and you just had to hit him.

And hitting someone that has been more than likely been restrained by handcuffs. You are no better than the guy that hit your sister now in my eyes, in this situation. There is no way that the officer should have let you violate that suspects rights. I am sure you know of one person that had this happen, his name was Rodney King......
Remember that the Use Of Force must be measured and can include the use of deadly force. If the guy pulls a knife on you and you cannot disengage, your life is in immenent peril. This is one situation that deadly force can be used. You however must be JUSTIFIED in the use of your force, so do not forget anything that you do or say.
Under section 10A of the Charter of Rights and Freedoms, you have rights. These right if you are arrested will be read to you. You have the right to speak if you like (which normally people who have been arrested or detained will do knowing full well that they are innocent) or speak to a lawyer, in private, in a timely fashion. This does not mean that you get to call a lawyer from the back of the patrol car. It does not mean that you get to call from a nice comfy office either. It means that you will be taken to a room that has a phone and that is about it. The number will be dialed for you, a legal aid duty lawyer is the person that will answer the call.
A suspect will generally shut his cookie trap, a complainant will generally speak and tell of the event, be required to write a statement and may be asked to provide evidence in court. Get a copy of your statement and of the officers notes.
