Question for the police officers of the board.
Say for instance a group of people wearing bandannas came onto my property during a birthday party..one holding a switch blade and ones holding a bat. Say one runs up swinging and tries to hit one of my friends..with the guy with a knife swinging at him too..if I were to bottle one of them, what kind of trouble am I looking at? I mean this is self defense..and one of the guys is trying to stab my friend.

i'm not a cop but i would say you would be going to jail for some time
if i set up my home and you rob me and the gun goes off that i had behind the side door where you came in (i'm looking at 25yrs )
what the cops will say is "you need to call 911"

Its kinda hard when your trying to stop your friend from being stabbed.

It all comes down to self defense!! See the way I look at it, cop or not!! If I seen someone going at someone with a Knife regardless if I knew them or not, I would def. stand in and do something about it!! REGARDLESS of consequence!! Its just the right thing to do, if you just stood there, you would be kickign yourself in the *** the rest of your life!!

It really is sad how the justice system works now adays, I remember when I was a young boy, that if someone broke into your house, and that person got shot/stabbed/hurt, it doesn't matter he was still in trouble and that was it, I remember when I was like 4 or 5 someone broke into our house and my pitbull attacked him and chewed his arm to the point he lost all motor functions and The city gave my dog an award!!! WTF??? now if that happened that dog would be put down, Owner would be charged and the theif would walk scott free !!

yes and no.... this topic has come up while dealing with some of the local officers, and really the less you say the better. and the cops arent really going to ask you any questions, other than do you know theres people and were they tresspassing and did he slip and hit his head on a bottle ........
there arent alot of cops out there that would see you go to jail because you were defending yourself. now on the other hand if you used excessive force and either killed the guy or seriously maimed him of if you have any formal training, ie any martial arts then you should know how to control yourself, and control the situation. But any one who studies will tell you it only takes one hit and there going to hit first. But really what you had done is very dangorus, becoause no one ever wins in a knife fight the best thing to do is run lock your self inside and call the cops get every one inside,and your friend should have had the chance to run. I could go in to more detail on why no one wins in a fight like that but im going to assume that we are all intelgent lol . have a good day and dont worry your safe and so is your friend .... i hope ....... and what did your buddy say to these guys anywase to prevoke them ?

The Criminal Code of Canada empowers you with this. This can be broken down into two sections. The first part is called trespass which is not a offence. You as a property owner or person charged in care of property have the right to use whatever force necessary, up to and including deadly force, to remove a person from your property. This force must be measured, meaning if the guy walks onto your property, you cannot shoot him dead. You must use the minimal amount of force necessary to remove them. If this person struggles with you, you are able to struggle back. If the person does not leave or continues to come back against your will and makes contact with you in a threatening manner, this is called assault by trespass and is indeed a indictable offence.
The second part here is that you are not allowed to use a weapon to further your means of removal. This means no bottles, batons, spray devices, firearms, bladed weapons, electrical discharge weapons or other general weapons. Should you use a weapon of any type, be it in self defence or not, you are going to get yourself into a world of trouble. This is assault on your part and is also a indictable offence.
If someone is coming at you with a weapon of any type, the best thing that you can do is to disengage and seek the aid of the police.

politely inform the officer that you want a lawyer before you give a statement
