The only recourse for you here is to pay the man. There is no doubt at all that the plate was not able to be read, I am sure that you will agree with the officer had you been in his vehicle doing the job that most people hate. You (unfortunately in this case) are the person that provided the officer with the reason and the opportunity to pull you over. Pay the ticket, you are responsible for the vehicle that you drive.

Now was there that much overspray from having your car rustproofed? I would be more concerned about the car as compared to getting the ticket. Was the ticket directly related to the rustproofing? If yes, take the ticket to the rustproofing dude and have him pay it. If he fails to, inform him that he was negligent in releasing to you your vehicle in the manner which it arrived, that being legal to drive when it was given to him. Enforce the fact that small claims court is the next option and it will cost him at least double what it is costing right now and that you will be guaranteed to win.

I highly doubt it was overspray from your rustproofing undercoating or whatnot, thats an excuse, I wonder what your car looks like if he got that much overspray on your license plate

Stupid ticket, I would just pay up.

Fight it for sure. It is your right.

I'll sleep better at night now, knowing that you aren't driving around with a dirty license plate, causing havoc.

Drew, enlighten us all. Say this happened to you, what would your basis be to fight the ticket?

Depending on the jurisdiction, there is a good chance of the officer not showing up to the court date.

He said he was in the parking lot. Also, it was just rustproofed. He may be able to plead his case, provide and explanation, and have a sympathetic judge.

Granted, I would have to look and see what the dollar amount of the ticket is, versus possibly missing time from work to fight it.

Two sides to every story and I'll bet there's something to be said in this one also.
Rustproofing drips but I have yet to see it drip enough to cause a marker to be unreadable.

Although to get a ticket, it doesn't have to be unreadable. For example the plastic covers that you can put over your license plate are technically illegal. When I had one on I was warned more than once, offered to take it off on the spot, and they said just do it some other time.

Gotta love selective enforcement.
