If you know you are trying to be served, whenever someone asks you if you are who you are, and usually by your full name, just say: "Who wants to know?" or "Why do you ask?" I don't think they can serve you if you don't say yes [img]graemlins/thumb.gif[/img]

i've been through this one. in Canada it's diff than in the states. they can leave it in your mail box here and consider you served. the only reason they try to serve you in person is to be sure that you got it, to speed the process. you can't run so just suck it up and take the summons so you may have more time to defend against it. if you wait you may not get it until just before you go to court. ask your lawyer.

If mailed, it needs to be sent registered mail with a signature.
If delivered in person, you do not need to ask the person's name, you only have to say "this is a summons" to them. If they don't take it, you can drop it at their feet.
You then fill out a oath of some sort, swearing that the person was served on whatever date.
Atleast that's how it works here in SK - I just served someone a while back for small claims.

if it is you, open up the letter, read it thoroughly until you understand everything.
the claims will be outrageous and this is on-purpose. dont get upset.
after you have it all together, call up your insurance compeny through whom you insure your home. if you are a dependant, call your parents insurance company.
many people do not realize this, but you are covered under most policies.
let the insurance company deal with it and delay it until the person dies of old-age and frustration.
worked for me... and i'm a milion dollars 'not' poorer
